Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Yout LLC ("Yout", "we", "us", or "our"), the company that operates Yout.chat and the Yout.chat API at api.yout.chat (together, the "Service"). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Yout.chat is a multi-model AI chat application and an OpenAI-compatible HTTP API that routes your prompts to a range of third-party large language and media models and returns their output to you. We act as an intermediary that brokers access, billing, and privacy controls; we do not create the underlying models. Available models, capabilities, and pricing may change at any time.

2. Eligibility & accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service, and at least 18 to purchase a paid plan. You are responsible for the activity under your account and for keeping your password and API keys confidential. Notify us immediately at support@yout.chat if you suspect unauthorized use. You may not share, resell, or sublicense your account or API keys.

3. Plans, credits & billing

  1. Credits. Usage of the Service is metered in credits. Each model consumes credits per request based on the length and type of the request. Plan credits are granted at the start of each billing cycle and do not roll over — unused plan credits expire when the cycle resets. Separately purchased top-up credits do not expire.
  2. Subscriptions auto-renew. Paid subscriptions renew automatically at the then-current price each billing period until cancelled. By subscribing you authorize us and our payment processors to charge your payment method on a recurring basis.
  3. Cancellation. You may cancel at any time from your account page. Cancellation stops future renewals; it does not retroactively refund the current period, and you keep access until the period ends.
  4. Price changes. We may change prices or plan contents. We will give notice of a material price increase to a renewing subscription before it takes effect.
  5. Taxes. Prices are exclusive of taxes unless stated; you are responsible for any applicable taxes.

4. Refunds

Refunds are handled under our Refund Policy. Except where required by law or expressly stated there, payments are non-refundable, and consumed credits are not refundable.

5. Acceptable use

You agree not to use the Service to:

  1. break the law or infringe the rights (including intellectual-property and privacy rights) of others;
  2. generate or distribute child sexual abuse material, content that sexualizes minors, or non-consensual intimate imagery;
  3. create malware, conduct phishing, harass or threaten others, or generate targeted disinformation;
  4. attempt to reverse-engineer, scrape, or circumvent the Service, its rate limits, or its credit metering, or identify the underlying upstream providers;
  5. resell raw Service output as a competing model-routing or inference product; or
  6. place automated load on the API beyond your plan's documented rate limits.

We may suspend or terminate accounts that violate this section, and may remove content or models at our discretion.

6. Your content and AI output

You retain ownership of the prompts, files, and other inputs you submit ("Inputs"). As between you and us, you own the output returned to you for a given Input ("Output"), to the extent it is capable of ownership and subject to the rights of third parties and the models' own terms. You are responsible for your Inputs and for how you use Outputs.

AI output is generated automatically and may be inaccurate, incomplete, or offensive. Do not rely on Outputs as a substitute for professional advice (legal, medical, financial, or otherwise). The same Input may produce different Outputs for different users, and we make no representation that Output is unique to you.

7. Privacy

Our Privacy Policy explains what we collect and how we handle it. By default your conversations stay in your browser and are not stored on our servers; we forward only the text of your message to the relevant model provider, stripped of identifying information. The Privacy Policy is incorporated into these Terms.

8. Third-party models and services

Outputs are produced by third-party models, and payments are processed by third parties (such as Stripe and PayPal). Your use of those underlying capabilities may also be subject to the providers' own acceptable-use rules. We are not liable for third-party acts or omissions.

9. Intellectual property

The Service, including its software, design, trademarks, and the "Yout" and "Yout.chat" names, is owned by Yout LLC and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. Nothing here transfers our intellectual property to you.

10. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT OUTPUT IS ACCURATE OR RELIABLE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUT LLC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Yout LLC from any claim, loss, or expense (including reasonable legal fees) arising out of your Inputs, your use of Outputs, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. On termination, the sections that by their nature should survive (including IP, disclaimers, liability limits, and indemnification) continue to apply.

14. Changes to these Terms

We may revise these Terms from time to time. If a change is material we will take reasonable steps to notify signed-in users. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict-of-laws rules. You and Yout LLC submit to the exclusive jurisdiction of the state and federal courts located in Connecticut for any dispute that is not subject to arbitration or small-claims resolution.
